Terms of Use

This is an Agreement between you (“User”) and the New Mexico Ethics Alliance (“NM ETHICS ALLIANCE”). These Terms of Use apply to your access to and use of any NM ETHICS ALLIANCE products, electronic or otherwise obtained from this NM ETHICS ALLIANCE web site www.nmethics.org, (“Products”), including contents of the NM ETHICS ALLIANCE members-only site, the database of resources, group pages or discussion threads, and any other information accessible to registered users. Access to and any use of the Products constitutes acknowledged acceptance of these Terms of Use.

  • License. NM ETHICS ALLIANCE grants User a non-exclusive, non-transferable license to access, copy content from and use Products in accordance with these Terms of Use. User may not copy or use the Products for commercial purposes, including but not limited to, providing fee-based consulting or professional services utilizing the Products, unless specifically authorized to do so by NM ETHICS ALLIANCE under a separate license agreement.
  • Term. The license to copy content and use Products is granted for one year. NM ETHICS ALLIANCE may terminate the license if you do not comply with these Terms of Use.
  • Copyright. All content provided on this web site, including but not limited to button icons, formatting, graphics, images, logos, software, and text, is copyrighted by The NM ETHICS ALLIANCE under United States law and is protected by worldwide copyright laws and treaty provisions. Any reproduction, modification, storage in a retrieval system or retransmission, in any form or by any means, electronic, mechanical, or otherwise, for reasons other than personal use, is strictly prohibited without prior written permission. You are welcome to make a link to any of the NM ETHICS ALLIANCE web pages published on the Internet. There is no need to request permission. Use of the NM ETHICS ALLIANCE logo is prohibited without written permission.
  • Disclaimer of Professional Advice. NM ETHICS ALLIANCE and the Products provide various types and levels of information about compliance with a wide array of laws, regulations and practices. Information is not the same as advice. The application of law to individual circumstances must be addressed for each unique situation. In preparing and providing the Products neither NM ETHICS ALLIANCE nor its Domain Managers, Business Editors, Legal Editors, authors and other contributors to the Products (collectively “Contributors”) are engaged in rendering legal, tax or any other professional advice or services. NM ETHICS ALLIANCE and its Contributors also disclaim all warranties and liability for the content of any such sites.
  • Enforcement. By agreeing to these Terms of Use, you release NM ETHICS ALLIANCE and the Contributors, including their officers, directors, partners and employees, and their affiliates, related entities and successors and assigns, from any liability, claim or cause of action whatsoever related to your access, use or reliance on Products, and you agree that all such parties are third party beneficiaries to your agreement to these Terms of Use and may use and rely upon the same to defend any claims.
  • Limitation of Liability. To the fullest extent permitted by applicable law, [NM ETHICS ALLIANCE and] the Contributors (including their officers, directors, partners and employees, and their affiliates, related entities and successors and assigns) shall not be liable to you or anyone else for any damages or costs, including any direct, consequential, incidental, indirect, punitive or special damages (including loss of profits, data, business or good will) in connection with the Products, whether or not liability is based on breach of contract, tort, strict liability, breach of warranty, failure of essential purpose or otherwise, and even if a party is advised of the likelihood of such damages.

COPPA:

The NM ETHICS ALLIANCE does not operate a commercial web site directed to children under 13. We do not collect personal information from children. We do not have actual knowledge that we are collecting personal information from children. If at a future date, the NM ETHICS ALLIANCE establishes or provides services on a web site that in anyway meets the criteria of the Act, the NM ETHICS ALLIANCE will ensure that full compliance is met by the NM ETHICS ALLIANCE in every aspect of the Act. Privacy:

How we handle the information we gather when you visit our web site.

  • Web server activity logs - Like most web servers on the Internet, our servers collect and store all of the information that your web browser sends when it requests a web page, including:
    • the name, domain, and numerical Internet address of the "host" computer (typically a computer belonging to your Internet Service Provider and not your personal computer) from which you access the Internet. For example, your host computer's name is Harriet and its numerical address is 63.145.212.102;
    • the date and time you accessed our site;
    • the Internet address of the web page that you came from;
    • the page you requested from our site and the number of characters sent to your computer; and
    • the information your web browser software sends as its so-called "User Agent," which typically identifies the browser software and may also indicate the operating system and type of CPU used in your personal computer.
    • It is impossible to determine the actual identity of an individual user from this information. The logs are periodically summarized and analyzed in order to study site usage over time and to perform other studies to help us improve the site's organization, performance, and usefulness.
  • Electronic mail - When you send us personal identifying information via email (that is, in a message containing a question or comment, or by filling out a form that email's us this information), we use it to respond to your requests. We may forward your email to individuals who are better able to answer your questions. We do not retain or distribute lists of email addresses to any parties outside of the NM ETHICS ALLIANCE. In no event, do we distribute lists of email addresses.
  • File transfer protocol (FTP) - The NM ETHICS ALLIANCE sites using the file transfer protocol may also store your email address if your web browser is configured to provide it. By default most web browser software does not send your email address; this option is configured through your browser preferences. In Netscape Navigator, for example, this option must be set by you through the Advanced preferences category by the item labeled, "Send email address as anonymous FTP password."
  • Online surveys - When you voluntarily provide us with personal information as part of an online survey, we use it to perform various quantitative and qualitative analyses to improve customer service and satisfaction. You are under no obligation to participate in such surveys. Non-participation will not inhibit your use of our web site in any way. If you provided the information to us in error, you may request its removal at any time.
  • Ordering products - When you voluntarily provide us with personal information such as name, shipping and billing address, and credit card number when ordering products online, we use the information to fulfill your order. We may forward the information to other computer systems (such as secure electronic commerce servers) to complete the requested transaction.
  • Marketing information - We may collect information from you, with your permission, that will allow us to provide various customer services, such as promotional materials and product or service availability notices. We will remove such information at your request.
